Whereas the exifting ftate of the Province renders the continuation of the Boards eftablifhed expreffly for the purpofes of facilitating the fettling of fuch lands as his Majefty, in his royal Beneficence has been pleafed to grant to the Loyalifts and reduced troops, inexpedient and unneceffary, It is hereby refolved that the authority heretofore granted to fuch Boards, fhall, from and after the fixth day of November, one thoufand feven hundred and ninety-four, ceafe and determine.

And whereas it is expedient, agreeably to the proclamation of his excellency the Lieutenant Governor, bearing date February 7th 1792, that adequate provifion fhould be made for the compliance therewith, in the moft effectual manner, It is hereby refolved, that all petitions whatfoever for grants of the wafte lands of the crown, be made to the Governor, Lieutenant Governor, or perfon adminiftering the government in Council, through the Clerk of the Council, except for the immediate location and encouragement of all fuch as it may be proper to admit, as fettlers within his Majefty's Province, and more efpecially for the due care and obfervance that none fuch be admitted but thofe whofe loyalty, induftry and morals fhall appear to entitle them to the benefits of his Majefty's Bounty, and render them ufeful inhabitants of this Province, It is hereby refolved, That all perfons profeffing the Chriftian Religion, and being capable of manual labor, who can adduce fatisfactory vouchers of their having paid obedience to the laws, and led a life of inoffenfive manners in the country where they laft refided, fhall in future be confidered, as qualified to be admitted to the poffeffion of lands within this Province, after having taken and fubfcribed the oaths of allegiance and fettlement prefcribed by act of Parliament.

Therefore any magiftrate living and refiding in the county wherein any perfon of fuch a defcription may wifh to become a refident, is duly authorized to give him a recommendation to the deputy furveyor of the county or diftrict for a location of lands in the following words.

profeffing having been this day examined by me, and taken the oaths prefcribed by law, is recommended for a location of two hundred acres of land within this county, provided it does not appear from the furveyor's books that he has had any prior grant of lands in any diftrict of this Province.

And it is hereby refolved that the deputy surveyor on the receipt of this certificate fhall proceed to make an affignment agreeable to the ufual form and manner.

And as it is expedient that the fees upon fuch grant be made public," refolved that they be ftated in this proclamation.

In a re-isue of this Order-in-Council the fees are raised to £4:9:6, viz. :

George the Third, by the grace of God, of Great-Britain, France and Ireland, King, defender of the Faith, and fo forth.

To all His Majesty's subjects of this Province, greeting.

Whereas the Loyalifts who adhered to the unity of the Empire, and others before and fince the eftablifhment of the government of this Province, received tickets or certificates of occupation, or locations, as teftimonials of the claims of fuch persons to receive grants of land, when by his Majefty's gracious directions they fhould be iffued;

And whereas deeds are now about to be made out to perfect titles to fuch lands as are poffeffed by the legal holders of tickets or certificates: but becaufe the deeds cannot be completed until the lawful claimants make known their claims by a production of the aforefaid tickets or certificates;

Now know ye that I, by and with the advice and confent of the Executive Council of this Province, do hereby direct all his Majefty's fubjects, refiding in the Weftern, Midland, and Eaftern Diftricts claiming to hold lands as aforefaid, do depofit their tickets or certificates, or fuch other teftimonial as they may poffefs, with the Clerks of the Peace of their refpective Diftricts (being authorized to receive the fame) that they may be duly tranfmitted to the Attorney General, in order that grants may iffue under the feal of the Province to the rightful claimants.

And in the Home Diftrict to the Attorney General: and I do make known to all perfons, that if fuch tickets or certificates are not fent to the perfons above mentioned within fix months from the date hereof, the lands may be deemed vacant, and granted to other applicants.

Whereas it appears by the minutes of the Council of the late Province of Quebec, dated Monday the ninth day of November 1789, to have been the defire of his Excellency Lord Dorchefter the Governor-General "To put a mark of honor upon the families who had adhered to the Unity of the

'Empire, and joined the Royal Standard in America, before the treaty of 'feperation in the year 1783," and for that purpofe it was then "Ordered, "by his Excellency in Council, that the feveral Land Boards (fhould) take courfe for preferving a regiftry of the names of all the perfons falling under the defcription aforementioned, to the end that their pofterity might be difcriminated from (the then) future fettlers in the parifh regifters and rolls of the militia of their refpective diftricts, and other pub"lic remembrances of the Province, as proper objects, by their perfevering "in the fidelity and conduct for honorable to their anceftors, for diftin"guifhed benefits and privileges;" but as fuch regiftry has not been generally made; and as it is ftill neceffary to afcertain the perfons and families, who may have diftinguished themfelves as abovementioned; as well for the caufes fet forth, as for the purpofes of fulfilling his Majefty's gracious intention of fettling fuch perfons and families upon the lands now about to be confirmed to them, without the incidental expences attending fuch grants:-Now KNOW YE, that I have thought proper, by and with the advice and confent of the executive council, to direct, and do hereby direct all perfons, claiming to be confirmed by deed under the feal of the province in their feveral poffeffions, who adhered to the unity of the empire and joined the royal ftandard in America, before the treaty of feperation in the year 1783, to afcertain the fame upon oath before the magiftrates in the michaelmas quarter-feffions affembled, now next enfuing the date of this proclamation, in fuch manner and form, as the magiftrates are directed to receive the fame; and all perfons will take notice that if they neglect to afcertain, according to the mode above fet forth, their claims to receive deeds without fee, they will not be confidered as entitled, in this refpect, to the benefit of having adhered to the unity of the empire and joined the royal ftandard in America before the treaty of feperation in the year 1783.

FORFEITURE OF LANDS.

26th May 1796.

Whereas in purfuance of his Majefty's gracious intention refpecting the granting and fettling of the wafte lands of the Crown in this Province, made known by my proclamation bearing date the feventh day of February 1792, many perfons made applications for certain portions of the ungranted lands of the Crown in their own names and the names of their affociates, which applications have in various inftances been complied with, fubject to the terms held out in the proclamation aforefaid:

And whereas it is a matter of public notoriety that many of the faid applicants have failed in the performance of the conditions required of

them:

And whereas others of the faid applicants who have received orders of Council preparatory to his Majefty's grant under the feal of the Province,

fubject to the terms aforefaid, from the Lieutenant-governor in Council, have wilfully perverted his Majefty's moft gracious intentions fignified in the proclamation aforefaid, namely, "That the refpective patentees of fuch "lands fhould take their eftates granted to them, feverally, free of quit rent, and of any other expences than fuch fees as are duly authorized and eftab'lifhed," by publickly and openly offering for sale fuch townfhips or portions of townfhips or by affixing an annual rent charge, to be paid for the grant of the fame and by many other finifter and illegal tranfactions in manifeft violation of the principles and conditions of the proclamation aforefaid, and of the terms under which they folicited for themfelves and affociates, fuch townfhips, or portion of townfhips :-Be it known therefore to all concerned, that it was this day refolved in Council, that all perfons claiming to hold lands by virtue of an order of Council to receive his Majefty's grant in and for the townfhips herein after named have forfeited the fame That the townfhips of Ofgoode, Wolford Montague, Ruffel, Kitley, Loughborough, Huntingdon, Rawdon, Murray, Clarke, Whitby, and Windham, are, and they are hereby declared to be vacant, and free for the admiffion of fuch perfons as fhall be defirous of occupying and fettling the fame agreeably to the terms and conditons of the proclamation aforefaid. And whereas many other townfhips and tracts of land have been appropriated under orders of the Lieutenant-governor in council to various applicants and their affociates-And whereas for want of information in refpect of the prefent improvement of the fame if any fuch be made or the future intentions of the faid applicants it does not appear to be expedient that fuch townfhips or tracts fhould at prefent be declared vacant-It was further refolved that all perfons who intend to avail themfelves of the benefit of any appropriations made in any townfhips or tracts of land whatfoever fhould be directed, and they are hereby directed accordingly, to fignify the fame to the Clerk of the honorable the Executive Council, on or before the firft day of June 1797, and to fhew caufe why the order in council made in their behalf fhould not be declared null and void.

And it was further refolved that all perfons who occupy lots of land in any of the townfhips or tracts aforefaid fhould be directed to apply (and they are hereby directed to apply) for their refpective patents or title deeds agreeably to the terms and conditions fpecified in the proclamation aforefaid, within the space of fix months, or fuch lands may be confidered as vacant and given to other applicants, of which all perfons will take notice and govern themfelves accordingly.

To fuch as are defirous of fettling on the Lands of the Crown, in the Province of Upper Canada.

Whereas, by a proclamation bearing date at Quebec, the feventh day of February, 1792, the terms and conditions on which perfons would be fettled, who are defirous of fettling on the lands of the crown, in his Majefty's province of Upper-Canada, were promulgated and made known; and it was by the eighth article in particular declared, that the refpective patentees were to take the eftates granted to them, feverally, free of quit rent, and of any other expences than fuch fees as are or may be allowed to be demanded and received by the different officrs, concerned in paffing the patents, and recording the fame, to be ftated in a table authorifed and eftablifhed by the government, and publicly fixed up in the feveral offices of the clerk of the council, of the furveyor-general, and of the fecretary of the province.

And, whereas it appears to be no longer expedient or neceffary that any grant or furvey of lands fhould be hereafter run out or marked by his Majefty's furveyor, or deputy furveyor, at the expence of the crown:-Now know ye, that I have tho't fit, by and with the advice of the executive council, to revife fo much of the eighth article of the faid proclamation, as declares that, "the refpective patentees are to take the eftates granted to them feverally free of quit rent, and any other expences than fuch fees as are or may be allowed to be demanded and received by the different officers concerned in paffing the patent and recording the fame," and to declare, that in addition to the fees eftablifhed by government on all grants of land, the refpective petitioners will,, in future, on the receipt of their patents, be charged with the expences of furvey, in proportion to the extent of their patents, which will be ftated in, and added to the table of fees, as is authorifed and eftablifhed by the government, and publicly fixed up in the feveral offices of the clerk of the council, of the furveyor-general, and of the fecretary of the province.
